4. Website Content & Services

The Site provides information about our logistics and related services and may include forms to request quotations or contact us. Content is for general information only and is not professional advice. Service quotes, schedules, and availability are subject to confirmation and separate service contracts.

4A. Service?Specific Conditions — Freight, Customs, Dangerous Goods, Heavy/Oversize Shipments

The information on the Site relates to services that are governed by separate service agreements, house bills of lading/air waybills, carrier terms, and local law. The following highlights common conditions. They do not replace any transport document or contract of carriage.

A. Ocean Freight & Quotations

  • Quotes are indicative and subject to carrier space/equipment, bunker and currency adjustments, GRI/PSS/war risk, congestion, and other surcharges. Unless stated, validity is 7–14 days and excludes duties/taxes, storage, demurrage/detention, inspection fees, and customs penalties.
  • Rates are based on details you provide (commodity, HS code, DG status, dimensions/weight, packaging, incoterms). Variations may trigger re?rating.
  • Transit times are estimates only; actual schedules may vary due to port conditions, weather, strikes, or carrier decisions.

B. Customs Brokerage/Trade Compliance

  • We may act as your agent for customs clearance and related filings. You warrant the accuracy, completeness, and legality of all information/documents provided (including classification, valuation, origin, permits, and licenses) and agree to provide a valid Letter of Authorisation/POA where required.
  • You remain responsible for duties, GST, fees, penalties, examinations, and storage arising from your shipment/data.
  • You must ensure compliance with export/import controls, sanctions, and embargoes applicable to the shipment, parties, and destination.

C. Dangerous Goods (IMDG/ICAO/IATA as applicable)

  • You must disclose DG status in advance and provide proper classification (UN number, class/division, packing group), SDS/MSDS, packaging/marking/labels, and shipper’s DG declaration as required by law.
  • We and carriers may refuse, re?containerise, neutralise, or dispose of misdeclared/unsafe DG at your risk/cost. You are liable for losses, fines, cleanup, and third?party claims arising from misdeclaration or non?compliance.

D. Heavy Lift, Out?of?Gauge (OOG) & Odd?Size Cargo

  • Provide accurate dimensions, weights (gross & net), centre of gravity, lifting points, and drawings/photos. VGM (Verified Gross Mass) is required for containerised cargo.
  • Special handling (e.g., flat racks/open?tops, mafi, breakbulk, special cranes, route surveys, police escorts, road permits, barge/ro?ro) may be needed and is subject to feasibility, permits, and third?party approval.
  • You must ensure suitable packaging, crating, and lashing points. Unless agreed in writing, lashing/securing is at shipper’s responsibility and must meet applicable codes/standards.
  • Additional charges may apply for equipment hire, surveyors, engineering, port handling, and waiting time.

E. Insurance

  • Unless expressly arranged and confirmed by us in writing, cargo moves at shipper’s risk. Upon request, we can arrange marine cargo insurance on your behalf, subject to insurer acceptance and premium.

F. Export Controls & Sanctions

  • We comply with applicable sanctions/export control laws. We may suspend or cancel services if we reasonably believe a shipment, party, or route would breach such laws.

G. Force Majeure

  • We are not liable for delay or failure caused by events beyond our reasonable control (including weather, war, strikes, epidemics, cyber incidents, port closures, regulatory actions).

5. User Responsibilities

You must:

  • provide accurate information in all forms and communications;
  • use the Site only for lawful purposes;
  • not attempt to bypass security, introduce malware, or disrupt the Site; and
  • not copy, scrape, or commercially exploit Site content without prior written consent.

6. Accounts & Submissions

If the Site enables user accounts, you are responsible for safeguarding your credentials and all activities under your account. By submitting any information to us via the Site, you grant us a non?exclusive license to use that information for the purposes stated on the Site and in our Privacy Policy.

7. Third?Party Links & Tools

The Site may contain links to third?party sites or use third?party tools (e.g., map embeds, analytics). We do not control and are not responsible for their content or policies.

8. Intellectual Property

All content on the Site (including text, graphics, logos, and software) is owned by Fairmacs or our licensors and is protected by law. You may view and print pages for personal, non?commercial use only. Our trademarks, trade names, and logos may not be used without our prior written consent.

9. Disclaimers

To the maximum extent permitted by Singapore law, the Site is provided “as is” and “as available” without warranties of any kind. We do not warrant that the Site will be error?free, uninterrupted, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by law, Fairmacs and our directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits, data, or business opportunities arising from or related to your use of the Site. Our total liability for any claim relating to the Site shall not exceed SGD 100 or the amount you paid (if any) to use the Site, whichever is higher.

11. Indemnity

You agree to indemnify and hold Fairmacs harmless from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from your use of the Site or breach of these Terms.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Singapore. You agree to the exclusive jurisdiction of the Singapore courts.
